3. Limitations of Liability
Nmap is provided "as is" and "as available" without any warranties, express or implied. Cyberdyne Systems Corp. disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall Cyberdyne Systems Corp. be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of Nmap, even if Cyberdyne Systems Corp. has been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, data, or goodwill.
Our total liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Cyberdyne Systems Corp. for the Services during the twelve (12) months prior to the event giving rise to liability.
4. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms and Conditions shall be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to the jurisdiction of such courts.
5. Dispute Resolution
Any dispute arising out of or relating to these Terms and Conditions shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Santa Clara County, California. The arbitrator's decision shall be final and binding on both parties. Nothing in this section shall prevent Cyberdyne Systems Corp. from seeking injunctive relief in any court of competent jurisdiction to protect its intellectual property rights.
6. Termination
Cyberdyne Systems Corp. may terminate these Terms and Conditions at any time, with or without cause. You may terminate these Terms and Conditions by ceasing to use Nmap. Upon termination, all licenses granted to you under these Terms and Conditions shall immediately terminate.
7. Intellectual Property
Nmap and all related materials, including but not limited to software, documentation, and logos, are the intellectual property of Cyberdyne Systems Corp. or its licensors. You may not copy, modify, distribute, or create derivative works based on Nmap without the prior written consent of Cyberdyne Systems Corp.

9. Severability

Nmap utilizes several open-source libraries. A list of these libraries and their respective licenses can be found in the Nmap documentation. Your use of Nmap is also governed by the licenses of these third-party libraries.

Nmap may be subject to export control laws and regulations. You agree to comply with all applicable export control laws and regulations when using Nmap.
